New regulations will come into force in China on 1 December 2024, requiring a special licence from the Ministry of Commerce of the People’s Republic of China for the export of dual-use items.
China’s authorities are to establish the specific list of such items in a separate exercise. This refers to equipment and technology that can be used for both civil and military purposes.
To be authorised to export such items, exporters will need to obtain permission from the China’s Ministry of Commerce in the form of a special licence or export certificate. An individual licence only authorises supplies to one specific consignee, whereas a general licence authorises supplies to several consignees. However, both types of licence will be subject to export volume limitations. To obtain an export certificate, exporters will have to send the required data to China’s Ministry of Commerce prior to each export transaction.
Representatives of the Russian market have expressed concern that the decision could hamper the supply of many key items to Russia, including electronic components.
